Shenzhen Weiguan Said Apple Inc. Cheat for iPad Trademark

 

On 6 December 2011, a first-instance judgment was passed on the dispute over trademark ownership of iPad. Shenzhen Intermediate People's Court ruled that it could not be established that the iPad trademark belonged to US Apple and IP Application Development Co., Ltd (IP Application).(via)

Apple Inc., the maker of iPad and iPhone, may face a ban from selling their products in mainland China.

Wei Guan Corp., the Hong Kong-listed technology company sued Apple for a trademark infringement in Shanghai.

AUTHORITIES are removing iPads from the stores in Shijiazhuang, the capital of Hebei Province after the Shenzhen Intermediate People's Court ruled that Apple Inc has violated the trademark of Shenzhen-based Weiguan Science and Technology Co Ltd.

Some electronics stores in Shijiazhuang have stopped selling iPads because the Shijiazhuang Industrial and Commercial Administration sealed their stocks of iPads after the court verdict.

Officials said they received a lawyer's letter from Weiguan, saying Apple's trademark iPad violated its rights. After verifying the authenticity of the information, the officials began to take action.

Under the Chinese law, products involved in trademark violation should be confiscated and Apple Inc could be fined up to five times of its profit made from selling iPads.

Officials said they are still checking the quantities of iPads sold in Shijiazhuang.(via)
